(i) Sağladığınız kredi kartı bilgilerinin doğru, eksiksiz ve tam olduğunu, (ii) satın alım işlemi için bu kredi kartını kullanma yetkinizin olduğunu, (iii) tarafınızca yapılan harcamaların kredi kartı şirketiniz tarafından onaylanacağını ve (iv) kargo ve işlem ücretleri ve varsa tüm vergiler de dahil olmak üzere belirtilen fiyatlar doğrultusunda harcamaları ödeyeceğinizi beyan ve garanti edersiniz.

BÖLÜM 5 - KARGO VE TESLİMAT
Kargo ve teslimat gecikmelerinden sorumlu tutulamayız. Tüm teslimat süreleri yalnızca tahmini olup garanti edilmez. Kargo şirketlerinden, gümrük işlemlerinden veya kontrolümüz dışındaki durumlardan kaynaklanan gecikmelerden sorumlu tutulamayız. Ürünleri kargo şirketine aktardığımızda, mülkiyet ve kayıp riski size geçer.

BÖLÜM 6 - FİKRİ MÜLKİYET
Tüm ticari markalar, markalar, metinler, görüntüler, görseller, grafikler, ürün değerlendirmeleri, video ve sesler dahil ancak bunlarla sınırlı olmamak üzere Hizmetler'imiz ve bu Hizmetler'imizin tasarımı, seçimi ve düzenlemesi, My Store mağazasına, bağlı kuruluşlarına veya lisans verenlerine aittir ve ABD ile yabancı patent, telif hakkı ve diğer fikri mülkiyet yasalarıyla korunmaktadır.
İşbu Şartlar, Hizmetler'i yalnızca kişisel ve ticari olmayan amaçlarınız için kullanmanıza izin verir. Hizmetler'de yer alan hiçbir materyali, önceden yazılı iznimiz olmadan çoğaltamaz, dağıtamaz, değiştiremez, türev çalışmalar oluşturamaz, kamuya açık olarak gösteremez, kamuya açık olarak icra edemez, yeniden yayımlayamaz, indiremez, depolayamaz veya iletemezsiniz. Burada açıkça belirtilenler haricinde, işbu Şartlar'daki hiçbir hüküm; My Store, Shopify veya herhangi bir üçüncü tarafın patent, ticari marka, telif hakkı ya da diğer fikri mülkiyet hakları kapsamında size herhangi bir lisans veya başka bir hak tanıdığı şeklinde yorumlanamaz ve böyle bir hak vermez. My Store mülkiyetindeki adlar, logolar, ürün ve hizmet adları, tasarımlar ve sloganlar; My Store veya onun bağlı kuruluşlarının ya da lisans verenlerinin ticari markalarıdır. Bu tür ticari markaları, My Store tarafından önceden verilmiş yazılı izin olmaksızın kullanamazsınız. Shopify'ın adı, logosu, ürün ve hizmet adları, tasarımları ve sloganları, Shopify'ın ticari markalarıdır. Hizmetler'de yer alan diğer tüm adlar, logolar, ürün ve hizmet adları, tasarımlar ve sloganlar, ilgili sahiplerinin ticari markalarıdır.

BÖLÜM 7 - İSTEĞE BAĞLI ARAÇLAR
Hizmetler'in bir parçası olarak üçüncü taraflarca sunulan müşteri araçlarına erişiminiz sağlanabilir ve bu araçlar tarafımızca izlenmemekte, kontrol edilmemekte veya girdisi bulunmamaktadır.
Bu tür araçlara erişimi herhangi bir garanti, beyan veya koşul olmaksızın ve herhangi bir onay olmaksızın "olduğu gibi" ve "mevcut olduğu şekilde" sağladığımızı kabul ve beyan edersiniz. İsteğe bağlı üçüncü taraf araçları kullanmanızdan kaynaklanan veya bununla ilgili hiçbir yükümlülüğümüz yoktur.
Site aracılığıyla sunulan isteğe bağlı araçların tarafınızca kullanımı tamamen kendi risk ve takdirinize bağlıdır ve ilgili üçüncü taraf sağlayıcı(lar) tarafından sağlanan araçların şartlarını bildiğinizden ve onayladığınızdan emin olmanız gerekir.
Ayrıca, gelecekte Hizmetler aracılığıyla yeni özellikler sunabiliriz (yeni araçların ve kaynakların piyasaya sürülmesi de buna dahildir). Bu tür yeni özellikler de Hizmetler'in bir parçası olarak kabul edilecek ve bu Hizmet Şartları'na tabi olacaktır.

BÖLÜM 8 - ÜÇÜNCÜ TARAF BAĞLANTILAR
Hizmetler, üçüncü taraflarca sağlanan veya işletilen web sitelerine yönelik materyaller ve köprüler (tüm ekli üçüncü taraf işlevsellikler de dahil olmak üzere) içerebilir. Erişmeyi seçtiğiniz herhangi bir üçüncü taraf materyalin veya web sitesinin içeriğini ya da doğruluğunu incelemekten veya değerlendirmekten sorumlu tutulamayız. Bu materyallere veya üçüncü taraf sitelere erişmek için Hizmetler'den ayrılmaya karar verirseniz, bunu tamamen kendi sorumluluğunuzda yapmış olursunuz.
Üçüncü taraf web sitelerine erişiminizden veya bu sitelerdeki herhangi bir ürün, hizmet, kaynak ya da içeriğin satın alımı veya kullanılmasıyla ilgili oluşabilecek zarar ya da hasarlardan sorumlu tutulamayız. Herhangi bir işlem yapmadan önce üçüncü tarafın politikalarını ve uygulamalarını dikkatlice inceleyip tam olarak anladığınızdan emin olun. Üçüncü taraf ürünler ve hizmetlerle ilgili şikayetler, talepler, endişeler veya sorular doğrudan ilgili üçüncü tarafa iletilmelidir.

BÖLÜM 9 - SHOPIFY İLE İLİŞKİ

My Store, size Hizmetler'i sunmamızı sağlayan Shopify tarafından desteklenmektedir. Ancak, mağazamızda yaptığınız tüm satış ve satın alımlar doğrudan My Store ile gerçekleştirilir. Hizmetler'i kullanarak Shopify'ın, satın alınan ürün ve hizmetlerden kaynaklanan herhangi bir yaralanma, hasar veya kayıp da dahil olmak üzere sizinle My Store arasındaki satışlardan kaynaklanan hiçbir şeyden sorumlu olmadığını kabul ve beyan edersiniz. İşbu belgeyle, My Store ile gerçekleştirdiğiniz satın alımlar ve işlemlerden kaynaklanan veya bunlarla ilgili olan tüm iddialar, zararlar ve yükümlülükler bakımından Shopify'ı ve bağlı kuruluşlarını açıkça ibra edersiniz.

BÖLÜM 10 - GİZLİLİK POLİTİKASI
Hizmetler aracılığıyla topladığımız tüm kişisel bilgiler, [LINK] üzerinden görüntülenebilecek Gizlilik Politikamıza tabidir ve bazı kişisel bilgiler, burada görüntülenebilecek Shopify'ın Gizlilik Politikası'na tabi olabilir. Hizmetler'i kullanarak, bu gizlilik politikalarını okuduğunuzu kabul etmiş olursunuz.
Hizmetler, Shopify tarafından barındırılmakta olduğundan Shopify, size Hizmetler'i sunmak ve geliştirmek amacıyla Hizmetler'e erişiminiz ve kullanımınızla ilgili kişisel bilgileri toplamakta ve işlemektedir. Hizmetler'e ilettiğiniz bilgiler, size hizmet sunulabilmesi amacıyla Shopify'a ve sizin ikamet ettiğiniz ülkeden farklı ülkelerde bulunabilecek üçüncü taraflara iletilecek ve kendileriyle paylaşılacaktır. Kişisel bilgilerinizin tarafımızdan, Shopify tarafından ve iş ortaklarımız tarafından nasıl kullanıldığına dair daha fazla bilgi için Gizlilik Politikamızı [LINK] inceleyin.

BÖLÜM 11 - GERİ BİLDİRİM
Herhangi bir fikir, öneri, geri bildirim, inceleme, teklif, plan veya diğer içeriği (topluca "Geri Bildirim") gönderir, yükler, yayınlar, e-posta ile gönderir ya da başka bir şekilde iletirseniz, bize bu Geri Bildirimi ticari kullanım da dahil olmak üzere herhangi bir amaçla herhangi bir ortamda kullanmak, çoğaltmak, değiştirmek, yayınlamak, dağıtmak ve görüntülemek için kalıcı, dünya çapında, alt lisanslanabilir, telifsiz bir lisans vermiş olursunuz. Örneğin, Hizmetler'i işletmek, sağlamak, değerlendirmek, geliştirmek, iyileştirmek, tanıtmak ve yükümlülüklerimizi yerine getirmek ve Hizmet Şartları kapsamındaki haklarımızdan yararlanmak için bu lisans kapsamındaki haklarımızı kullanabiliriz.
Ayrıca: (i) tüm Geri Bildirimlerin sahibi olduğunuzu veya Geri Bildirimler ile ilgili tüm gerekli haklara sahip olduğunuzu; (ii) Geri Bildirim gönderiminizle bağlantılı olarak aldığınız her türlü tazminat veya teşviki açıkladığınızı ve (iii) Geri Bildiriminizin işbu Şartlar'a uygun olacağını da beyan ve garanti edersiniz. (1) Geri Bildiriminizi gizli tutma; (2) Geri Bildiriminiz için tazminat ödeme veya (3) Geri Bildiriminize yanıt verme yükümlülüğümüz yoktur ve olmayacaktır.
Tamamen kendi takdirimize bağlı olarak yasa dışı, saldırgan, tehdit edici, iftira niteliğinde, karalayıcı, pornografik, müstehcen veya başka bir şekilde sakıncalı olduğunu ya da herhangi bir tarafın fikri mülkiyetini veya işbu Hizmet Şartları'nı ihlal ettiğini belirlediğimiz Geri Bildirimleri izleyebilir, düzenleyebilir ya da kaldırabiliriz, ancak bunları yapma yükümlülüğümüz yoktur.
Geri Bildiriminizin telif hakkı, ticari marka, gizlilik, kişilik veya diğer kişisel ya da mülkiyet hakları dahil olmak üzere herhangi bir üçüncü tarafın hakkını ihlal etmeyeceğini kabul edersiniz. Ayrıca, Geri Bildirim'inizin iftira niteliğinde veya diğer şekilde hukuka aykırı, kötüye kullanıma açık ya da müstehcen içerikler barındırmayacağını ve Hizmetler'in veya ilişkili herhangi bir web sitesinin işleyişini herhangi bir şekilde etkileyebilecek bilgisayar virüsü ya da başka bir zararlı yazılım içermeyeceğini kabul edersiniz. Yanıltıcı bir e‑posta adresi kullanamaz, kendiniz dışında biriymiş gibi davranamaz veya herhangi bir Geri Bildirimin kaynağı konusunda bizi ya da üçüncü tarafları başka bir şekilde yanlış yönlendiremezsiniz. Verdiğiniz her türlü Geri Bildirimden ve doğruluğundan yalnızca siz sorumlusunuz. Siz veya herhangi bir üçüncü tarafça gönderilen Geri Bildirimler için hiçbir sorumluluk kabul etmeyiz ve hiçbir yükümlülük üstlenmeyiz.

BÖLÜM 12 - HATALAR, TUTARSIZLIKLAR VE EKSİKLİKLER
Zaman zaman Hizmetler'de, ürün açıklamaları, fiyatlandırma, promosyonlar, teklifler, ürün kargo ücretleri, nakil süreleri ve stok durumu ile ilgili olabilecek yazım hataları, tutarsızlıklar veya eksiklikler içeren bilgiler bulunabilir. Herhangi bir hatayı, yanlışlığı veya eksikliği düzeltme, bilgileri değiştirme ya da güncelleme ve herhangi bir bilginin yanlış olması durumunda önceden haber vermeksizin siparişleri iptal etme hakkını saklı tutarız (siparişinizi vermiş olsanız bile).

BÖLÜM 13 - YASAKLI KULLANIMLAR
Hizmetler'e yalnızca yasal amaçlarla erişebilir ve Hizmetler'i yalnızca yasal amaçlarla kullanabilirsiniz. Şu amaçlarla doğrudan veya dolaylı olarak Hizmetler'e erişemez ya da Hizmetler'i kullanamazsınız: (a) herhangi bir yasa dışı veya kötü niyetli amaçla; (b) herhangi bir uluslararası, federal, eyalet, il veya yerel düzenleme, kural, yasa ya da yönetmeliği ihlal etmek amacıyla; (c) bizim veya başkalarının fikri mülkiyet haklarını ihlal etmek amacıyla; (d) çalışanlarımızdan herhangi birini veya başka bir kişiyi taciz etmek, istismar etmek, aşağılamak, zarar vermek, karalamak, iftira atmak, küçümsemek, tehdit etmek ya da incitmek amacıyla; (e) yanlış veya yanıltıcı bilgi iletmek amacıyla; (f) işbu Şartlar'a uygun olmayan herhangi bir materyali bile bile göndermek, almak, yüklemek, indirmek, kullanmak veya yeniden kullanmak amacıyla; (g) "istenmeyen e-posta", "zincirleme mektup", "spam" ya da benzeri diğer tanıtım ya da pazarlama içeriklerini göndermek veya gönderilmesini sağlamak amacıyla; (h) başka bir kişi veya kuruluşun kimliğine bürünmek ya da bürünmeye teşebbüs etmek amacıyla; (i) Hizmetler'in başkaları tarafından kullanılmasını veya Hizmetler'den yararlanılmasını kısıtlayan ya da engelleyen veya bizim tarafımızdan My Store, Shopify ya da Hizmetler'in kullanıcıları açısından zararlı veya hukuki sorumluluk doğurucu olarak değerlendirilebilecek herhangi başka bir davranışta bulunmak amacıyla.
Buna ek olarak şunları yapmamayı da kabul edersiniz: (a) Hizmetler'in işlevselliğini veya çalışmasını etkileyecek şekilde virüs ya da herhangi bir tür kötü amaçlı kodu yüklememeyi veya iletmemeyi; (b) Hizmetler'in herhangi bir bölümünü çoğaltmamayı, kopyalamamayı, satmamayı, yeniden satmamayı veya kötüye kullanmamayı; (c) Başkalarına ait kişisel bilgileri toplamamayı veya izlememeyi; (d) Spam yapmamayı, kimlik avı yapmamayı, dolandırıcılık yapmamayı, hileli bahaneler kullanmamayı, örümcek, tarama veya kazıma gibi faaliyetlerde bulunmamayı veya (e) Hizmetler'in veya ilgili web sitelerinin, diğer web sitelerinin ya da İnternet'in güvenlik özelliklerine müdahale etmemeyi veya bunları atlatmamayı. Herhangi bir zamanda, işbu Şartlar'ın herhangi bir bölümünü ihlal ettiğinizi tespit etmemiz halinde, hesabınızı askıya alma, devre dışı bırakma veya sonlandırma hakkını saklı tutarız.

BÖLÜM 14 - FESİH
İşbu anlaşmayı veya Hizmetler'e (veya Hizmetler'in herhangi bir kısmına) erişiminizi, tamamen kendi takdirimize bağlı olarak, bildirimde bulunmaksızın herhangi bir zamanda feshedebiliriz ve siz de fesih tarihine kadar olan tüm borçlardan sorumlu olmaya devam edersiniz.
İşbu sözleşmenin feshi sonrasında aşağıdaki bölümler geçerliliğini korumaya devam edecektir: Fikri Mülkiyet, Geri Bildirim, Fesih, Garantilerin Reddi, Sorumluluğun Sınırlandırılması, Tazminat, Hükümlerin Bağımsızlığı, Feragat; Anlaşmanın Bütünlüğü, Devir, Uygulanacak Hukuk, Gizlilik Politikası ve doğası gereği fesih sonrası devam etmesi gereken diğer hükümler.

BÖLÜM 15 - GARANTİLERİN REDDİ
Hizmetler üzerinde veya aracılığıyla sunulan bilgiler yalnızca genel bilgilendirme amacıyla sunulmaktadır. Bu bilgilerin doğruluğunu, eksiksizliğini veya kullanışlılığını garanti etmeyiz. Bu tür bilgilere güvenmenizin riski yalnızca size aittir. Sizin veya Hizmetler'in başka bir ziyaretçisinin ya da Hizmetler'in içeriğinden haberdar olabilecek herhangi birinin bu tür materyallere güvenmesinden kaynaklanan tüm sorumluluk ve yükümlülükleri reddederiz.

HİZMETLERİ KULLANIMINIZIN KESİNTİSİZ, ZAMANINDA, GÜVENLİ VEYA HATASIZ OLACAĞINI GARANTİ, BEYAN YA DA TAAHHÜT ETMEYİZ. BÖLÜM 16 - SORUMLULUĞUN SINIRLANDIRILMASI

BÖLÜM 17 - TAZMİNAT
My Store, Shopify ve bağlı kuruluşlarımızı, iş ortaklarımızı, yöneticilerimizi, yetkililerimizi, çalışanlarımızı, temsilcilerimizi, yüklenicilerimizi, lisans verenlerimizi ve hizmet sağlayıcılarımızı, (1) işbu Hizmet Şartları'nı veya referans olarak dahil edilen belgeleri ihlal etmeniz, (2) herhangi bir yasayı veya üçüncü bir tarafın haklarını ihlal etmeniz ya da (3) Hizmetler'e erişiminiz ve kullanımınız nedeniyle veya bunlardan kaynaklanan, üçüncü taraflara ödenmesi gereken makul avukat ücretleri de dahil olmak üzere herhangi bir kayıp, zarar, sorumluluk ya da talep karşısında tazmin etmeyi, savunmayı ve zararsız tutmayı kabul edersiniz.
Tazminat yükümlülüğü doğuran tüm talepleri size bildiririz, ancak bildirimde gecikilmesi, siz maddi olarak zarar görmedikçe yükümlülüklerinizi ortadan kaldırmaz. Böyle bir talebin savunmasını ve uzlaşmasını, avukat seçimi de dahil olmak üzere, masrafları size ait olmak kaydıyla kontrol edebiliriz, ancak size maddi olmayan yükümlülükler getirecek tüm talepler için, rızanız olmadan (makul bir gerekçe olmaksızın reddedilmemek kaydıyla) uzlaşma yapmayız. Tazmin edilen taleplerin savunmasında iş birliği yapmakla ve ilgili belgeleri sağlamakla yükümlü olursunuz.

BÖLÜM 18 - HÜKÜMLERİN BAĞIMSIZLIĞI
İşbu Hizmet Şartları'nın herhangi bir hükmünün geçersiz, hükümsüz veya uygulanamaz olduğu tespit edilse dahi, söz konusu hüküm yürürlükteki hukukun izin verdiği en geniş ölçüde uygulanabilirliğini koruyacak olup uygulanamaz kısım Hizmet Şartları'ndan ayrılmış sayılır ve bu tür bir tespit, şartların geri kalan hükümlerinin geçerliliğini ve uygulanabilirliğini etkilemez.

BÖLÜM 19 - FERAGAT; ANLAŞMANIN BÜTÜNLÜĞÜ
İşbu Hizmet Şartları'nın herhangi bir hakkını veya hükmünü kullanmamamız veya uygulamamamız, bu hak veya hükümden feragat edildiği anlamına gelmez.
İşbu Hizmet Şartları ile bizim bu sitede veya Hizmet'e ilişkin olarak yayınladığımız tüm politikalar ya da işletme esasları, sizinle bizim aramızdaki anlaşmanın ve mutabakatın bütünlüğünü teşkil eder, Hizmet kullanımınızı düzenler ve sizinle bizim aramızda (Hizmet Şartları'nın önceki sürümleri de dahil ancak bunlarla sınırlı olmamak üzere) daha önce yapılmış tüm sözlü veya yazılı anlaşmaların, iletişimlerin ve tekliflerin yerini alır.
İşbu Hizmet Şartları'nın yorumlanmasında doğacak belirsizlikler, metni düzenleyen taraf aleyhine yorumlanamaz.

BÖLÜM 20 - DEVİR
Önceden yazılı onayımız olmaksızın işbu Anlaşma'yı veya işbu Şartlar kapsamındaki herhangi bir hakkınızı ya da yükümlülüğünüzü devredemez, aktaramaz veya temlik edemezsiniz ve bu yöndeki her türlü girişim hükümsüz sayılır. İşbu Şartlar'ı ve haklarımızı ve yükümlülüklerimizi sizin onayınız veya bildiriminiz olmadan devredebilir, aktarabilir ya da temlik edebiliriz.

BÖLÜM 21 - UYGULANACAK HUKUK
